I understand that using the golf simulator involves physical activity, swinging a golf club, and launched golf balls inside an enclosed hitting area. These activities carry an inherent risk of injury, including strains, sprains, bruising, eye injury, and impact from a club or ball, as well as risk of damage to property. I voluntarily choose to participate with full knowledge of these risks.
On behalf of myself and my heirs, I release, waive, and hold harmless THE 19TH FAIRWAY, its owners, employees, and agents from any and all claims, demands, or causes of action arising out of my participation, including injury, death, or property damage, except to the extent caused by THE 19TH FAIRWAY's gross negligence or willful misconduct.
I agree to follow all instructions from THE 19TH FAIRWAY staff, to swing only from the designated hitting area, to stay behind the hitting line when others are swinging, to keep the enclosure closed while in use, to use the equipment only as intended, and to refrain from horseplay or use while impaired by alcohol or drugs. I understand THE 19TH FAIRWAY may end a session for unsafe behavior without refund.
I confirm that I am physically able to participate and that I have no medical condition that would make participation unsafe for me.
If the participant is under 18, a parent or legal guardian must sign this waiver on their behalf and supervise the minor for the entire session. No minor may use the simulator without a signed waiver on file.
